Personal information

The Data Protection Act 1998 gives you rights to request and receive your own personal data.  A request for your personal information is called a Subject Access Request.

The PCCS will consider your request in accordance with the requirements of the DPA.  We may charge a fee of up to £10.

The PCCS will only provide the requested information where the requestor has satisfied the PCCS of his/her identity.  To request your personal information please complete our Subject Access Request form and send it to:

We will respond to your request within 40 days of receipt of a request.  This period cannot start until we have received all the relevant information, proof of your identity and the required fee if necessary.

If you are dissatisfied with the way in which we have handled you subject access request you may complain to the Information Commissioner, or to the Court for an order under section 7(9) of the DPA.  The contact details for the Information Commissioner are as follows:

Corporate Information

The Freedom of Information (Scotland) Act 2002 and Environmental Information Regulations give you the right to access official information held by public authorities.

If you wish to access information under the Freedom of Information (Scotland) Act 2002 (FOISA), which is not available under our publication scheme, you must make your request in writing or in any form that can be kept for future use, for example, an audio recording or video tape.

We will respond to you within 20 working days of receipt of your request.

If you are unhappy with our decision, you have the right to request a review.  If you wish to exercise this right, you must do so within forty working days following the date of receipt of our decision. 

Your request for a review must be in writing and you must specify your name and address for correspondence.  You must also identify the decision that you wish to be reviewed.  Should you wish to request a review, please address your request to:

If you are dissatisfied with the outcome of a review, you have a right under the FOISA to appeal to the Scottish Information Commissioner.  If you wish to do so, you must appeal to the Commissioner within six months following the date of receipt of the review notice.  The Commissioner's contact details are as follows:

Environmental Information
 

If you want information about the environment, your request will be dealt with under separate environmental information rules called the Environmental Information (Scotland) Regulations.  If you require environmental information you can make your request in writing (letter, email or fax), on the telephone or in person.
